What is an IRS Late Review?

When an Immediate Roadside Sanction is issued in Alberta, drivers have 7 days to request a review through SafeRoads Alberta. If that deadline passes without a review being filed, the sanction remains in effect and you lose your opportunity to contest the matter.

A late IRS review is a formal process that allows you to request an extension of that 7-day deadline. If SafeRoads Alberta approves the extension, you are then given 7 days to request an IRS review, just as if the original deadline had not passed.

To be eligible, your request must be made within one year of the date your sanction was issued, and you must demonstrate that exceptional circumstances prevented you from filing within the original 7-day deadline.

What Happens if a Late Review Is Approved?

A late review is not the appeal itself. It’s a request to reopen the 7-day filing window. If SafeRoads Alberta approves your late review, you are then given 7 days to file a full IRS review on the merits of your case.
That full review examines whether grounds for cancellation can be established under Alberta’s regulatory requirements. If ground for cancellation exist, the sanction can be cancelled in it’s entirely. That means financial penalties are reimbursed, the IRS is removed from your driving abstract, and insurance or employment impacts may be reversed.
Furthermore, any associated consequences still in effect, including the licence suspension, vehicle seizure, and mandatory program requirements, are cancelled.

There are no guarantees in any review process, but a late review preserves options that would otherwise be permanently closed.
